These Terms of Service (“Terms”) govern your access to and use of Obzerv (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Obzerv is a software-as-a-service platform for monitoring website and API availability, performance, and SSL/TLS certificates, with related notification and reporting features. We may add, remove, or change features at any time.
2. Your account
You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized access at support@obzerv.xyz.
You must be at least 16 years old (or the minimum age in your country) and able to form a binding contract to use the Service.
3. Acceptable use
You agree not to:
- monitor systems you do not own or are not authorized to monitor;
- use the Service to launch denial-of-service attacks, scanning, or any activity that disrupts third-party systems;
- attempt to bypass rate limits, plan limits, or other technical controls;
- reverse-engineer, scrape, or copy any non-public portion of the Service;
- upload unlawful, infringing, or malicious content; or
- resell or sub-license the Service without our written permission.
We may suspend or terminate accounts that violate these rules, with or without notice, at our sole discretion.
4. Plans, billing, and refunds
Paid plans are billed in advance on a monthly or annual basis through our payment processor. Fees are non-refundable except where required by law or as expressly stated by us. You may cancel at any time; cancellation stops future renewals but does not refund the current billing period.
We may change pricing with at least 30 days' notice for existing paid subscribers; new pricing applies at your next renewal.
5. Your data
You retain all rights to the data, monitor configurations, and content you submit to the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide and improve the Service.
We process personal data in accordance with our Privacy Policy.
6. Service availability
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an “as is” and “as available” basis. Specific availability commitments, if any, are stated in your plan or in a separate written agreement.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by Obzerv and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as permitted here.
8. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, fail to pay, or for operational, legal, or security reasons. Upon termination, your right to access the Service ends and we may delete Customer Data after a reasonable period.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Monitoring data is informational and is not a substitute for redundant systems or independent verification.
10. Limitation of liability
To the maximum extent permitted by law, Obzerv will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data, arising out of or related to the Service. Our aggregate liability for any claim is limited to the greater of (a) the amounts you paid us in the twelve months preceding the claim or (b) one hundred US dollars.
11. Indemnity
You agree to indemnify and hold Obzerv harmless from any claim arising out of your Customer Data, your use of the Service, or your violation of these Terms.
12. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-product notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Obzerv is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law in your country grants you additional rights.
